Service Terms

These terms apply to paid reviews, consulting, website, marketing, implementation and related services provided by Jayden Webb.

These Service Terms form part of the agreement between Jayden Webb and the person or business purchasing or engaging a service. A specific quote, proposal, written scope or service page may add further details for a particular engagement.

Agreement to these terms

These Service Terms apply when you:

  • purchase a fixed-price review through this website
  • accept a quote, proposal or written project scope
  • engage Jayden Webb for consulting, website, marketing, implementation or related services

By purchasing a service, accepting a quote or otherwise confirming an engagement, you agree to these Service Terms together with the relevant service description, quote, proposal or written scope.

Fixed-price reviews

Fixed-price reviews are designed as defined assessment services rather than open-ended consulting engagements.

Website Snapshot

$89 AUD

A focused written review of one priority website journey or issue, based on the scope described on the Website Snapshot service page.

Website & Customer Journey Review

$249 AUD

A broader written assessment of the website and important customer journey areas described on the Customer Journey Review service page.

SEO, GEO & Google Visibility Review

$249 AUD

A written assessment of relevant search, discovery and Google visibility areas based on the scope described on the Visibility Review service page.

A fixed-price review includes only the assessment and follow-up expressly described for that service. Implementation, website changes, advertising changes, technical development, copywriting or ongoing consulting are not included unless specifically stated.

Delivery timing for fixed reviews

Website Snapshot

The Website Snapshot is normally delivered within 3 business days after both payment and the completed review intake have been received.

Customer Journey Review

The Website & Customer Journey Review is normally delivered within 5 to 7 business days after both payment and the completed review intake have been received.

Visibility Review

The SEO, GEO & Google Visibility Review is normally delivered within 5 to 7 business days after both payment and the completed review intake have been received.

The delivery period does not begin when payment is made if the required intake information has not yet been submitted.

If important information is missing or access reasonably required for the agreed assessment has not been provided, delivery may be delayed until that information is available.

If an unexpected issue materially affects the stated timeframe, you will be contacted as soon as reasonably practical.

Follow-up and clarification

Website Snapshot

The Website Snapshot includes the written report and one clarification question by email.

It does not include a meeting, implementation session or ongoing consulting unless separately agreed.

Website & Customer Journey Review

The Website & Customer Journey Review includes the written review and one round of follow-up clarification by email.

If a short discussion would materially help, Jayden may suggest a call separately.

SEO, GEO & Google Visibility Review

The Visibility Review includes the written report and one clarification question by email.

Additional analysis, meetings or implementation work may be quoted separately.

Quoted projects and consulting work

Larger website, marketing, implementation and consulting engagements will normally be defined through a written quote, proposal, scope or email agreement.

The written project scope should identify the work to be completed and may also specify:

  • deliverables
  • estimated timing
  • dependencies
  • client responsibilities
  • project price or hourly rate
  • payment milestones
  • included revisions or review stages
  • items specifically excluded from scope

Where the specific written scope conflicts with a general description on the website, the specific written scope will apply to that engagement, subject to rights that cannot be excluded by law.

Payments

Fixed-price reviews

Fixed-price reviews purchased through the website must be paid in full before the review begins.

Quoted project work

Unless a written quote or proposal states otherwise, quoted project work requires:

  • 50% deposit before work begins
  • 50% final payment on completion, before final handover or go-live

Work is not required to commence until the agreed deposit or initial payment has been received.

Final deliverables, production access, transfer of project files or go-live may be withheld until amounts properly due for the completed scope have been paid.

Hourly work

Hourly consulting or implementation may be invoiced according to the arrangement agreed before work begins.

Scope and requested changes

Services are priced and scheduled based on the agreed scope.

If you request work outside that scope, Jayden may:

  • provide a separate quote
  • charge additional work at an agreed hourly rate
  • revise the project timing
  • decline the additional work if it cannot reasonably be accommodated

Small clarifications do not automatically constitute a scope change. Material additions, new deliverables, substantial revisions or new requirements generally do.

A review identifies or prioritises issues. It does not include correcting every issue identified unless implementation is separately included or purchased.

Client responsibilities

You are responsible for providing information, content, feedback, access and approvals reasonably required to complete the agreed service.

You should ensure that information supplied is accurate and that you have authority to provide any content, data, branding, account access or other material supplied for the engagement.

Delays caused by missing information, approvals, content, access or third-party decisions may affect the delivery date.

Where a project relies on client-supplied content, Jayden is not responsible for independently verifying every factual, legal or regulatory statement contained in that material unless verification is expressly included in the scope.

Account access and credentials

Some engagements may require access to website platforms, analytics, advertising accounts, ecommerce platforms, domain systems or other business tools.

Where possible, you should provide appropriate user access rather than sharing master passwords.

If credentials must be provided, both parties should use a reasonably secure method appropriate to the system involved.

You remain responsible for maintaining appropriate account ownership, billing relationships and administrator access to your own platforms.

Third-party services and platforms

Services may involve or depend on third-party platforms such as WordPress, Shopify, Stripe, Google, Meta, Microsoft, hosting providers, email platforms, plugins or other software.

Unless specifically included in the written scope, third-party charges such as hosting, software licences, advertising spend, domains, subscriptions, themes, plugins or platform fees are the client’s responsibility.

Jayden Webb does not control third-party platform outages, policy changes, algorithm changes, account suspensions, software bugs or feature changes.

Where a third-party change materially affects an active project, reasonable efforts will be made to identify an appropriate path forward, but additional work may need to be separately scoped.

Results and outcomes

Consulting, website, customer experience, search and marketing work is intended to improve the quality of decision-making, execution or customer experience, but specific commercial results cannot be guaranteed.

Results may depend on factors outside Jayden Webb’s control, including:

  • customer demand
  • pricing and product-market fit
  • business operations
  • competitor activity
  • advertising budgets
  • platform algorithms
  • search engine changes
  • client implementation
  • third-party systems

SEO and visibility work does not include a guarantee of a particular search ranking, traffic level, revenue level or timeframe for ranking improvement.

Advertising work does not include a guarantee of a particular ROAS, cost per lead, sales volume or conversion rate.

Cancellations, changes of mind and refunds

Fixed-price reviews

If you request cancellation before work on the review has started, the purchase price will be refunded in full.

Once work has started, a change-of-mind refund is not available for work already undertaken.

If only part of the service has been performed and a refund or adjustment is required by law or otherwise agreed, any amount will take into account work already reasonably completed.

Quoted projects

If you cancel a quoted project after work has begun, you remain responsible for payment for work properly completed up to the cancellation date, together with any approved third-party costs or non-refundable commitments incurred for the project.

Any unused part of an advance payment will be handled having regard to work already completed, contractual commitments and rights available under applicable law.

Nothing in this section removes or limits any refund, re-performance or other remedy that you are entitled to under the Australian Consumer Law or another law that cannot be excluded.

Intellectual property and project materials

Each party retains ownership of intellectual property it owned before the engagement.

Client-supplied logos, content, photographs, trademarks, data and other materials remain the client’s property or the property of their respective owners.

Unless a written project agreement states otherwise, final project-specific deliverables created and paid for as part of the agreed scope may be used by the client for the business purpose for which they were created.

Jayden Webb retains ownership of pre-existing methods, templates, reusable code, know-how, systems, frameworks and general tools used in producing the work.

A client must not resell or commercially distribute a review, framework or reusable consultancy resource as a standalone product unless expressly permitted in writing.

Confidentiality

Information clearly provided in confidence for the purpose of an engagement will be treated as confidential and used only as reasonably necessary to provide the service, administer the engagement or comply with legal obligations.

Confidentiality does not apply to information that:

  • is already public through no breach of confidence
  • was already lawfully known
  • is independently developed without use of the confidential information
  • must be disclosed by law

Personal information is also handled in accordance with the Privacy Policy.

Liability

Services are provided with reasonable care and skill appropriate to the agreed scope.

To the extent permitted by law, Jayden Webb is not responsible for indirect or consequential loss arising from matters outside the agreed service scope, client decisions, third-party platform failures or changes implemented contrary to the recommendations provided.

You remain responsible for final business decisions and for determining whether recommendations are appropriate for your organisation, customers, systems and regulatory obligations.

Nothing in these Service Terms excludes, restricts or modifies rights, guarantees or remedies that cannot lawfully be excluded or limited.

Australian Consumer Law

Services supplied to consumers may come with guarantees under the Australian Consumer Law, including that services will be provided with due care and skill, will be reasonably fit for a disclosed purpose in applicable circumstances and will be supplied within a reasonable time where no timeframe has been agreed.

These Service Terms are intended to operate alongside those rights, not replace them.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy where doing so would be unlawful.

Questions, concerns and disputes

If you believe there is a problem with a service, raise it as soon as reasonably possible so the issue can be understood and, where appropriate, addressed.

Both parties should first attempt to resolve a disagreement through good-faith discussion before commencing formal proceedings, except where urgent legal relief is reasonably required.

These Service Terms are governed by the laws applicable in Victoria, Australia.

Subject to rights and jurisdictions that cannot be excluded, disputes are subject to courts and tribunals with appropriate authority in Victoria, Australia.
